By use of the Website/Mobile app you shall be contracting with Zippy Deals and all such terms and conditions including the policies constitute your binding obligations, with Zippy Deals.

For the purpose of these Terms of Use, wherever the context so requires “You” or “User” shall mean any natural or legal person who has agreed to become a buyer through the Website/Mobile app by providing Registration Data while registering on the Website/Mobile app as Registered User using the computer systems/tab or mobile application. 

Zippy Deals allows the User to surf the Website/Mobile app or making purchases after registering on the Website/Mobile app. The term “We”, “Us”, “Our” shall mean Zippy Deals.

USER ELIGIBILITY

Any persons, above the age of 18 years of age, are eligible to use the site 

If you are a minor, between the age of 13 and 18, you may use the site under the supervision of a parent or legal guardian or an adult who agrees to be bound by these Terms of Use and who can transact on behalf of you as the registered user.

As a minor, you are prohibited from purchasing any material which is for adult consumption and the sale of which to minors is prohibited

Any Person who is “Incompetent to Contract” within the meaning of the Indian Contract Act, 1872 are not eligible to use the Site.

LICENSE & SITE ACCESS

Zippy Deals grants you a limited sub-license to access and make use of this site, solely for the purpose of buying any products and services listed in the site.  Your usage of the same shall only be for personal purposes and not for any commercial purpose.

This license does NOT permit:-

You may not use any meta tags or any other codes or texts, of any nature, utilizing the Site’s or Zippy Deals name or any trademarks used in this site. Any unauthorized use terminates the permission or license granted by Zippy Deals and may be subjected for legal action.

CONDITIONS OF USAGE

You hereby agree, that:-

• You will use the services provided by the Site, for lawful purposes only and comply with all applicable laws and regulations while using and transacting on the Site.
• You will provide authentic and true information in all instances where such information is requested from you. Zippy Deals reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true, either wholly or partly, we have the right in our sole discretion to reject the registration and debar you from using the Services without prior intimation.
• You shall authorize Zippy Deals or it’s agent to contact you for any transactional purposes related to your order/account.
• You shall be accessing the services available on this Site and transacting at your own risk and shall be using your best and prudent judgment before entering into any transaction through this Site.
• The address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.
• Before placing an order you shall check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item’s description.
• That you shall make the payment through any of the following methods:-

                        (2) APPROVED DEBIT or CREDIT CARDS
                        (3) CASH ON DELIVERY                        

You may not use the Site for any of the following purposes:

• Gaining unauthorized access to any computer systems.
• Interfering with any other person’s use or enjoyment of the Site.
• Breaching any applicable laws.
• Interfering or disrupting networks or web sites connected to the Site.
• Making, transmitting or storing electronic copies of materials protected by the copyright of Zippy Deals, unless permitted by Zippy Deals.

ACCOUNT & REGISTRATION OBLIGATIONS

You shall register and login for placing orders on the Site. You can register yourself, by creating a username and password or by using your existing social login accounts of Google or Facebook.

You shall keep your account and registration details current and correct for communications related to your purchases from the site.

By agreeing to the terms and conditions, you are agreeing to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing or by contacting the customer care representative.

PRICING

• The products displayed in the site, shall be sold at MRP rates, which is including GST or any other applicable taxes,
• Any discounts offered shall be clearly mentioned, in the site with the original price and the discount offered on the product.
• A nominal fee of RS.35.00 shall be charged extra for all orders up to RS.300.00
• FREE of CHARGE Delivery shall be provided for any order above RS.300.00.
• The prices mentioned in the site, shall be the latest ones on that particular day, only.
• Price variations, both Positive and Negative Variations might occur, depending on the market conditions.
• In case the prices are higher or lower on the date of delivery, the price considered for invoicing and payments shall only be the price, mentioned in your Order Note.
• No Additional charges shall be made from you for any price rise and No Refund shall be given to you for any price drops.
• The sale of products listed on the Website/Mobile app is subject to availability. Zippy Deals shall not be held liable in case, the product chosen by you cannot be supplied for the reasons beyond Zippy Deals’ control.

CANCELLATION POLICY

By CUSTOMER

You can cancel your order, either partially or fully, anytime, at least 2 hours before the delivery slot that you have opted while placing the order. No cancellation fee shall be charged in any such cases.  

If you cancel your order after the delivery slot, a nominal fee of RS. 100.00 shall be charged, for expenses incurred by Zippy Deals. In such cases, the entire amount of the order, less the aforesaid charges, shall be refunded.

By Zippy Deals

For any circumstances, beyond our control, such as any harthals, curfew, government instructions, closure of roads/supply sources, etc. the order might get either cancelled or postponed. We shall be updating you, in any such, unfortunate situation.

If we suspect any fraudulent transaction by any customer or any transaction, which defies the terms & conditions for using the Website/Mobile app, we reserve the full right to cancel such orders.

We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them.

In any of the above situations, you shall be entitled to claim your full refund, of your payment.

RETURN & REFUND POLICY

We have a “Open Return & Refund Policy” which entitles all our customers to return the product at the time of delivery if due to some reason you are not satisfied with the quality or freshness of the product. We will take the returned product back with us and issue a credit note, equivalent to the value of the return products which will be credited to your bank account. Also if it’s agreeable for you a coupon equivalent to the amount shall be issued to you, which you can use for your future purchase with us.

ADDITIONAL COST PAYABLE

In the event a non-delivery occurs on account of a mistake by you that is by a wrong name or address or any other wrong information, provided by you or if you or your representative is not available at the address, any extra cost incurred by Zippy Deals for redelivery shall be claimed from you.

PRODUCT IMAGES

We make every effort to display the actual and exact images for all our products that appear on the Website/Mobile app as accurately as possible. However, due to various reasons, such as changes in packaging designs, the color discrepancies due to your monitor, etc. the actual product might get a bit or fully changed in its packaging. You agree to accept these changes, but in case of any product delivered differs in content/brand, you shall be entitled for a full refund.

WARRANTIES AND LIABILITIES

• Zippy Deals shall make no representation with regard to quality, color, specifications, image, performance, material, ingredients etc.
• Zippy Deals’ endeavors is to make available the products ‘as is’ where basis. The liability of Zippy Deals is limited to the extent of displaying.

COUPON USAGE  

• No two offers can be clubbed together
• Coupon discount will be only to the maximum amount mentioned in the coupon
• Coupon discount is not applicable to Promotional Items and the value of coupon discount will reduce by proportionate sale amount of Promotional Items

MODIFICATION OF TERMS & CONDITIONS OF SERVICE

SMITHS & PERTERS, May at any time, modify the Terms & Conditions of Use of the Website/Mobile app without any prior notification to you.

You can access the latest version of these Terms & Conditions at any point of time on the Site. You should regularly review the Terms & Conditions on the Site. In the event the modified Terms & Conditions is not acceptable to you, you have the right to discontinue usage of the Service. However, if you continue to use the Service you shall be deemed to have agreed to accept and abide by the modified Terms & Conditions of Use of this Site.

GOVERNING LAW AND JURISDICTION

This User Agreement shall be construed in accordance with the applicable laws of the State of Kerala and the Republic of India. The Courts at Kochi/Aluva shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Zippy Deals and his/her decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held at Aluva.

Reviews, Feedback, Submissions

•  All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed/submitted/offered to the Site on or by this Website/Mobile app or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively, the “Comments”) shall be and remain the property of Zippy Deals.
• Such disclosure, submission or offer of any Comments shall constitute an assignment to Zippy Deals of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, Zippy Deals owns exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments.

Zippy Deals is and shall be under no obligation to:-

This clause shall survive the expiry or termination of this User Agreement.

TERMINATION

This User Agreement is effective unless and until terminated by either you or Zippy Deals. You may terminate this User Agreement at any time, provided that you discontinue any further use of this Site. Zippy Deals may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, Such termination will be without any liability to Zippy Deals. 

Upon any termination of the User Agreement by either you or Zippy Deals, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the User Agreement or otherwise.

Zippy Deals’ right to any Comments shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Website or affect any liability that may have arisen under the User Agreement.
